Legally, going after uploaders is more convenient for the RIAA since they can connect directly to filesharers (by downloading the file) without actually looking more like hypocrites by uploading the files themselves and going after the downloaders.However, since the actual "copy" (which is what copyright law is all about) is created by the downloader, it's far more logical that they should be more liable. Besides, if "making available" is illegal, why are libraries legal? They "make available" books, CDs and movies. If somebody uses that opportunity to create a copy (either by scanning or ripping), is that the library's problem? According to the RIAA, yes.Basically, the RIAA has turned copyright completely backwards for the sake of convenience, and the Luddite courts in the US have blindly followed along.
